In this course, we will study the difference between a deed and title. We will learn about one of the most important real estate documents: the deed. We will learn requirements for a valid deed, different kinds of deeds, and the importance of recording a deed. We will study title: the concept or theory of real property ownership. We will review elements related to title to property. We will study real estate closings, or settlements, including the documents and roles of all parties involved. We will differentiate between escrow and roundtable closings. We will also review settlement statements, including the HUD-1 Settlement Statement. We will also study the different costs and fees associated with closing and who is generally responsible for those costs. We will review the Real Estate Settlement Procedures Act (RESPA) and its requirements. We will study affiliated business arrangements. Finally, we will review basic concepts related to ethics, including a brief look at the Code of Ethics that is published by the National Association of REALTORS®. We will review federal antitrust laws. We will study specific types of antitrust violations. We will also review fraud and misrepresentation. |
